2. Description of the Service

Suptogo provides a self-service rental of Stand-Up Paddle (SUP) equipment, which may include a paddleboard, an adjustable paddle, and a safety leash (the “Equipment”).

The Equipment is provided “as is” and is intended exclusively for recreational use by the User under their sole responsibility.

By accepting these Terms, the User acknowledges that stand-up paddleboarding is a water sport involving inherent risks, including but not limited to falls, collisions, weather changes, sea conditions, fatigue, injury, or drowning.

3. Eligibility, Registration and User Declarations

3.1 User Requirements

By making a reservation, the User expressly declares and guarantees that:

  • They are of legal age and have full legal capacity.
  • They are physically and mentally fit to practice water sports.
  • They do not suffer from any medical condition that could endanger themselves or others.
  • They are not under the influence of alcohol, drugs, or any toxic substances.
  • They understand and voluntarily accept the risks inherent to maritime and weather conditions.

If the User allows minors to use the Equipment, the User declares to be their legal guardian or to have obtained explicit authorization from the legal guardian and assumes full responsibility for the minor’s actions, safety, and any damages or claims arising therefrom.

3.2 Account Security

Access credentials are personal and non-transferable.
The User is fully responsible for any activity carried out through their account. In case of loss, theft, or suspected misuse, the User must notify Suptogo immediately at info@suptogo.es.

4. Booking, Payment and Prices

All payments are made exclusively by credit card via the Suptogo App.
Prices shown in the App include VAT and are final.

Suptogo does not guarantee uninterrupted availability of the service and reserves the right to modify prices, locations, or availability at any time.

5. Duration and Termination

The contractual relationship begins upon acceptance of these Terms and remains in force indefinitely.

Suptogo reserves the right to suspend or terminate access immediately and without compensation in case of breach of these Terms, unsafe behavior, misuse of equipment, or violation of applicable regulations.

6. Use of Equipment and User Obligations

6.1 Inspection and Acceptance

The User must inspect the Equipment within the first 10 minutes of rental.
Failure to report defects within this period implies full acceptance that the Equipment is complete, functional, and in perfect condition.

6.2 Proper Use and Return

The User agrees to:

  • Use the Equipment exclusively for its intended purpose.
  • Follow local maritime, beach, and safety regulations.
  • Return the Equipment clean, complete, undamaged, and on time.

Late returns may result in additional charges.

6.3 Damage, Loss and Costs

The User is fully liable for:

  • Any damage, loss, theft, or deterioration of the Equipment.
  • Any rescue, recovery, or third-party costs arising during the rental period.
  • Any damage caused to third parties or property.

If the cause of damage cannot be clearly determined, the User assumes full responsibility, unless proven otherwise.

7. Weather Conditions and Force Majeure

The User acknowledges that weather and sea conditions may change suddenly.

Suptogo:

  • Does not guarantee safe conditions at any time.
  • Is not responsible for injuries, accidents, or damages caused by weather, sea state, currents, wind, waves, marine life, or visibility.

Refunds due to unsafe conditions are not automatic and will be assessed case by case, at Suptogo’s sole discretion.

8. Assumption of Risk and Full Liability Waiver

By using Suptogo’s services, the User expressly and irrevocably:

  • Assumes all risks, known or unknown, related to paddleboarding and maritime activities.
  • Releases and waives any present or future claims against Suptogo SL, its directors, employees, partners, and suppliers for:
    • Personal injury
    • Death
    • Material damage
    • Economic loss
    • Third-party claims

This waiver applies even in cases of ordinary negligence, except where liability cannot be legally excluded.

9. Limitation of Liability

To the maximum extent permitted by law, Suptogo’s total liability shall be strictly limited to the amount paid by the User for the specific rental giving rise to the claim.

Under no circumstances shall Suptogo be liable for:

  • Indirect or consequential damages
  • Loss of enjoyment
  • Lost profits
  • Emotional distress

10. Applicable Law and Jurisdiction

These Terms shall be governed by Spanish law.
Any dispute shall be submitted to the courts of Barcelona, Spain, expressly waiving any other jurisdiction.

11. Explicit Acceptance

By completing the reservation and checking the acceptance box, the User confirms having read, understood, and expressly accepted these Terms, including the assumption of risk, waiver of liability, and limitation of responsibility.
